Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Fragments (“we,” “us,” or “our”) governing your use of the Fragments mobile application (the “App”) and our website at fragmentsgame.com (together, the “Service”).

By downloading, installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you obtain the App through the Apple App Store or Google Play, those stores' terms may also apply to your download and use of the App.

Fragments is a collaborative storytelling game for entertainment. Players take turns adding to a shared story, typically with 3–12 participants.

• Local play uses one device passed between players. Story data for local games is stored on that device unless you use optional online or sharing features.
• Online play lets you create or join rooms, invite friends, and play from separate devices. Online features require an internet connection and, for some capabilities, an account.
• Website. The website provides information about the game, download links, support, and these legal documents. You cannot play full games on the website.

We may add, change, or remove features at any time. The App is currently offered without in-app purchases or paid subscriptions.

You must be old enough to consent to these Terms where you live, and at least 13 years old (or the minimum age required in your country). If you are under the age of majority, you represent that you have a parent or guardian's permission to use the Service.

Accounts. Online features may offer passwordless email sign-in, Sign in with Apple, Sign in with Google, or limited guest access. You are responsible for activity under your account and for keeping access to your email and device secure. Usernames must follow the format required in the App (lowercase letters, numbers, and underscores).

Guest access. Guest play may not include all features available to signed-in users (for example, friends, story sharing, or certain notifications).

You and other players create story text, names, reactions, profile information, and related material (“User Content”). You retain ownership of User Content you create, subject to the license below.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process User Content only as needed to operate the Service (for example, to run an online room, deliver a shared story to a friend you select, or generate optional narration).

You represent that:

• You have the right to submit your User Content
• Your User Content does not violate law or third-party rights, and is not harassing, hateful, sexually exploitative of minors, or otherwise objectionable
• You will not use the Service to spam, impersonate others, or distribute malware

We may remove User Content or suspend access that violates these Terms, applicable law, or that we reasonably believe harms the Service or other users. You can report objectionable content or users in the App through Settings → Safety & reporting or from player menus; reports are reviewed by the Fragments team. You may also email support@fragmentsgame.com.

The Service may use automated systems to generate opening scenarios, daily prompts, and optional spoken narration. AI output can be inaccurate, inappropriate, or unexpected. You are responsible for reviewing content in your games and for how your group uses the Service.

AI features are provided for entertainment only. They are not professional, medical, legal, or other advice.

When using online features, you agree to:

• Play fairly and respect other participants
• Not attempt to access rooms or accounts you are not invited to use
• Not disrupt servers, scrape the Service, or reverse engineer the App except as law allows
• Follow any time limits, turn rules, or room settings chosen by the host

Room codes, invites, and shared stories are intended for people you know. Do not share private room links publicly if you do not want strangers to join.

You may not:

• Use the Service for any unlawful purpose
• Collect or harvest usernames or personal data from other users without permission
• Circumvent security, rate limits, or access controls
• Use the Service to train machine learning models on User Content without our written consent
• Resell or commercially exploit the Service without authorization

The Fragments name, branding, App software, website design, and other materials we provide are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as needed to refer to the Service.

If you believe content on the Service infringes your copyright, contact support@fragmentsgame.com with enough detail for us to investigate.

Our Privacy Policy explains how we collect and use information. By using the Service, you acknowledge that policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted, secure, or error-free operation, or that stories, AI output, or notifications will always be available or accurate.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY US DOLLARS (US $50).

Nothing in these Terms limits liability that cannot be limited under applicable law (including certain consumer rights in your country).

You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your misuse of the Service, or your violation of these Terms, to the extent permitted by law.

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive termination.

To close an online account and delete associated data, use Delete account in the App under Profile Settings. This permanently removes your authentication record, profile, friends, and associated online data. If you cannot use the App or need help with an edge case, contact support@fragmentsgame.com.

We may update these Terms from time to time. The “Last updated” date shows when they were last revised. If we make material changes, we may notify you in the App or on this page. Continued use after changes become effective constitutes acceptance, to the extent permitted by law.

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Before filing a formal dispute, you agree to contact us at support@fragmentsgame.com and try to resolve the issue informally.

If you are a consumer in the European Economic Area or another region with mandatory local consumer protections, you may have rights to bring claims in your country of residence; nothing here limits those rights where they cannot be waived.
